THE DIFFICULTY OF PROVING RURAL ACTIVITY IN THE FACE OF INSS REQUIREMENTS: AN EVALUATION OF THE MAIN ACCEPTED EVIDENCE AND THE MAIN CAUSES OF DENIAL IN RURAL RETIREMENT APPLICATIONS

Abstract

Proving rural activity remains one of the greatest challenges faced by policyholders before the National Institute of Social Security (INSS). This study, "The Difficulty of Proving Rural Activity in the Face of INSS Requirements: Assessment of the Main Accepted Evidence and the Main Causes of Rejection in Rural Retirement," aims to analyze the main documentary, legal, and administrative obstacles that compromise access to this essential social security right. This research adopts a qualitative approach, based on bibliographic and documentary analysis, supported by doctrinal, legal, and case law sources. Constitutional provisions, sub-legal norms, and higher court decisions were examined, providing a broad overview of the topic. It was found that INSS evidentiary requirements often diverge from rural realities, excessive formality compromises access to the benefit, and the insured's lack of technical knowledge contributes to the denial of many requests. It is concluded that the Judiciary plays an essential role in enforcing this right by admitting the combination of material and testimonial evidence, contrasting with administrative rigor. Thus, the study demonstrates that the implementation of rural retirement requires not only protective regulations but also proactive and inclusive state action, committed to promoting equity, social justice, and human dignity.
