BETWEEN PUNISHMENT AND RE-EDUCATION: THE EFFECTIVENESS OF PUBLIC POLICIES AIMED AT THE RESOCIALIZATION OF DOMESTIC VIOLENCE OFFENDERS IN BRAZIL

This article analyzes punishment and rehabilitation: the effectiveness of public policies aimed at the social reintegration of domestic violence perpetrators and their contribution to the protection of women victims of domestic violence. While the Maria da Penha Law (Law No. 11,340/2006) represented a step forward in the protection of women's rights, practical results regarding the reeducation and social reintegration of perpetrators remain limited. In this regard, we seek to understand how the measures provided for in legislation and the rehabilitation programs implemented by the government have contributed, or not, to reducing recidivism and transforming patterns of violent behavior. It is noteworthy that the Maria da Penha Law was amended in 2020, requiring perpetrators to participate in rehabilitation programs, which impedes the early detection of new attacks. In light of this, the issue takes on great importance when addressing the balance between punishment and rehabilitation as tools for combating domestic violence, analyzing whether policies for the resocialization of abusers are effective in reconciling the effectiveness of justice with the guarantee of protection for women.
