CONSUMER CONTRACTUAL RELATIONS AND LOST TIME: A ANALYSIS OF THE THEORY OF PRODUCTIVE DEVIATION AND THE ESSENTIALITY

This article endeavored to study the legal foundations that are presented in view of the importance of vital time in consumer relations from the attribute of time as a legal good of economic value. The school of the theme was justified given the emphasis on time and the theory of the consumer's productive deviation in the jurisprudence of the Superior Court of Justice - (STJ), as well as, before the municipal legislation of the State of Amazonas, in both situations they highlighted the time as off-balance sheet damage violated by the supplier before the consumer. At first, it addressed the principles and social and economic rights that protect consumer protection in the Federal Constitution of 1988. Then, it suggested some concepts of goods in Civil Law and, finally, a parallel with the Consumer Protection Code and its rights equity, adequate information and use of time and existential harm. The deductive method and bibliographical research were used. Finally, it was understood that time is an irrevocable and unavailable legal asset that needs to be protected.
