THE (RE)HUMANIZATION OF PROPERTY RIGHTS: A FOCUS ON VULNERABLE URBAN COMMUNITIES

This article proposes a critical reflection on property rights in the Brazilian urban context, focusing especially on vulnerable communities. Based on the perspective of the social function of property and the right to the city, the study investigates how recent legal and institutional mechanisms, such as REURB and Special Zones of Social Interest (ZEIS), can contribute to the (re)humanization of property rights. The methodology is qualitative, using literature review and document analysis of legislation and urban experiences. The article highlights the need for more inclusive and participatory interpretations of property rights that acknowledge the social dynamics of vulnerable urban communities and promote spatial justice.
