HIRING OF SUPPORT FOUNDATIONS UNDER LAW 14.133/2021: REQUIREMENTS, LIMITS AND INTERPRETATIVE CHALLENGES

Considering the entry into force of Law No. 14,133/2021, which redefined the public procurement and contracting regime, it becomes imperative to reevaluate the partnership instruments between Federal Higher Education Institutions (IFES) and support foundations. The objective is to analyze the qualification requirements, the legal nature of the bond (singular versus shared execution), and the limits of the concept of institutional development from the perspective of external control. To this end, a documentary and bibliographic analysis is carried out, examining Law No. 8,958/1994, Decree No. 7,423/2010, and the consolidated jurisprudence of the Federal Court of Accounts (TCU), notably Rulings 2,731/2008 and 1,178/2018. Thus, it is observed that the new law maintains the possibility of a bidding waiver but intensifies governance requirements, prohibiting generic contracts ("umbrella contracts") and requiring a strict nexus between the object and finalistic projects of teaching, research, and innovation. It is concluded that legal certainty depends on the implementation of active transparency mechanisms and the correct distinction between management support and the outsourcing of core activities.
