AUTONOMY OF WILL AS A FUNDAMENTAL HUMAN RIGHT AT THE END OF LIFE

Considering that the end of life demands the highest level of protection for human dignity, the central problem identified is the insufficient effectiveness of autonomy of will within Advance Directives of Will (ADWs), particularly in light of the Brazilian legislative gap and the persistent prevalence of medical paternalism. This study aims to analyze decisional autonomy as a fundamental human right applicable at the end of life, highlighting its legal configuration, ethical limits, and its relationship with international instruments for the protection of the human person. To this end, a qualitative, bibliographic, and documentary methodology is employed, based on international treaties, resolutions of the Federal Council of Medicine, specialized doctrine, and comparative foreign regulations. Thus, it is observed that recognizing ADWs as an existential expression of individual liberty strengthens the protection of fundamental personality rights, reducing conflicts among patients, families, and healthcare teams. The results demonstrate that autonomy, when formalized with legal certainty, helps prevent disproportionate medical interventions and guides person-centered care practices. It is concluded that autonomy of will at the end of life must be understood as a full expression of human rights, requiring specific regulation capable of ensuring predictability, protection, and effectiveness in advance care planning.
