ECONOMIC ORDER IN THE 1988 FEDERAL CONSTITUTION: EFFECTS ON STATE INTERVENTION IN THE ECONOMY

Abstract

The 1988 Federal Constitution is expressly directed towards changing social structures, encompassing norms of the economic order that guide the structuring and role of the State in the economy. This research seeks to answer how the evolution of the economic order has affected the intervention of the Brazilian State in the economy. The general objective of the research was to demonstrate the concrete effects on the State's actions resulting from constitutional reforms concerning the Economic Order. The specific objectives are to examine the provisions relating to the foundations and principles, to verify the effects of constitutional amendments since 1988, and to investigate the relationship between the economic order and policies for implementing sustainable development. Methodologically, a deductive method with a qualitative approach was adopted, combining legal research, statistical data, jurisprudence, and bibliography. The research is divided, first, into the analysis of basic norms of the economic order; second, changes resulting from constitutional amendments; and finally, its interaction with sustainable development, results, and discussions. The results indicate that the economic order has undergone transformations, shifting from directing state intervention towards an approach grounded in neoliberalism. However, norms that guarantee sustainable development remain.
