RECOGNIZED VULNERABILITIES – SAME-SEX COUPLES, NON-CISNORMATIVE GENDER, AND THE NEW HERMENEUTICS OF “VULNERABILITY” IN THE MARIA DA PENHA LAW

This research analyzes the judgment of the Writ of Injunction No. 7452 by the Brazilian Federal Supreme Court (STF), which recognized the legislative omission of the National Congress in protecting LGBTQIA+ victims – especially gay and bisexual men, travestis, and trans women – by extending the urgent protective measures of the Maria da Penha Law to these groups. Law No. 11,340/2006 was originally enacted to protect cisgender women in the face of historical cultural subordination. However, ABRAFH and the National LGBTI+ Alliance filed the Writ of Injunction No. 7452 demanding access to formal mechanisms of protection, support, and prevention. This study focuses on the hermeneutic foundations of the STF’s decision, particularly the vote of Justice Alexandre de Moraes, who invoked the prohibition of insufficient protection – derived from the principle of proportionality – and the state responsibility guaranteed by article 226, § 8 of the Federal Constitution to justify applying the law to male same-sex relationships and cases involving travestis and transsexuals. The research aims to map the rapporteur’s arguments, examine how constitutional hermeneutics expanded the concept of vulnerability to include gender and identity as markers of subordination, and analyze the limits of this extension, which remains strictly extrapenal, as the breach of protective measures in such cases does not constitute a crime under Article 24-A of the law. The guiding question is: how does the STF’s new hermeneutics of “vulnerability” in the MI 7452 address domestic violence in same-sex and non-cisnormative gender relationships, and what are the scope and limitations of this interpretative inclusion in expanding the effectiveness of the Maria da Penha Law? The study draws theoretically from the works of Barroso (2008), Bento (2008; 2015; 2017), Butler (1993; 1999; 2004; 2009; 2015), Cantú (2009), Corrêa (2008; 2011), Crenshaw (1995; 2019), Dias (2006; 2016; 2019), Foucault (1975; 1977; 1978; 1993; 2003; 2010), Fraser (2003; 2013), Halberstam (1998; 2011), Haritaworn (2014), Honneth (2003), Moran (2003), Parker (2008; 2011), Petchesky (2008), Piovesan (2012; 2019), Rich (1980), Rios (2006), Skeggs (2003), Spade (2015; 2020), among others. The research is qualitative (Minayo, 2007), bibliographical and descriptive (Gil, 2008), with a comprehensive analytical approach (Weber, 1949). The analysis demonstrated that the STF’s interpretive expansion of the Maria da Penha Law incorporated the notion of vulnerability in an intersectional way, recognizing non-cisnormative gender identities and same-sex orientations as legitimate markers of subordination. The decision represents progress by ensuring civil protective measures to these groups, yet relevant limitations persist, especially due to the absence of criminal consequences for the breach of such measures. The adopted hermeneutics proved innovative, although it faces challenges of effectiveness and normative consolidation. The research revealed tensions between symbolic advancement and structural legal gaps. In summary, it is a partial and unequal inclusion in the protection system.
