Abstract

This article aims to answer the question posed by the topic, using as a theoretical framework for research decisions against the law in general. All discussions focus on these decisions based on extreme injustice and founded on injustice. The study of these decisions leads us to the conclusion that they are part of a world of totalitarian regime, in which fair laws are not applied and norms emerge to strengthen the existing regime, considered unjust. The methodology used was analysis, with books as research sources. The analysis leads us to a result that it is necessary to know that it is possible to assess judicial decisions that deviate from the procedure used in the application of the norm, that is, contradict the text of the law, so that justice can be achieved and the law can be applied within the law, based on the idea of a fairer law in any regime.
