GESTATIONAL SURROGACY: IMPACTS ON CAREER AND FAMILY FROM AN ECONOMIC LAW PERSPECTIVE

Gestational surrogacy is a multifaceted topic that lies at the intersection of civil and economic law. This study explores the impacts of this practice on careers and family dynamics in the United States, drawing on Claudia Goldin's theory regarding women's journey toward equity in the labor market. It is argued that, while gestational surrogacy can potentially mitigate the 'maternity penalty' and promote gender equality, the lack of robust and uniform regulation in the U.S. intensifies information asymmetry and the risk of exploitation of economically vulnerable women. A critical analysis of American public policies reveals shortcomings and guides the proposal of a regulatory framework that balances economic efficiency with the protection of human rights and dignity. It is concluded that the adoption of an ethical and just framework is essential to ensure greater inclusion and equity in the labor market and in family structures.
