Abstract

This article analyzes the controversial intersection between artistic expression in carioca funk/trap and accusations of apology to crime in Brazil. Starting from the justification that artistic freedom, constitutionally guaranteed, collides with the limits imposed by social and penal control, the study's main objective is to analyze the lyrics of MC Poze do Rodo, a prominent artist of the genre, which have been the subject of investigation for apology to crime. The methodology employed is qualitative in nature, with an exploratory and descriptive character, using content analysis of lyrics, documentary and legal media analysis, and bibliographic review. The results obtained indicate the complexity of the legal interpretation of the lyrics in contrast to the perspective of artistic freedom and the sociocultural context in which they are produced. It is concluded that structural racism and institutional prejudice influence the criminalization of peripheral art, highlighting the need for a contextualized analysis that transcends the literal reading of the lyrics, in order to unravel the dynamics between social representation, community experience, and the brazilian legal framework.
