The recognition of animals as sentient beings has emerged as a new legal concept under doctrinal discussion and one that influences mandatory legal norms. In light of the affection for animals, the concept of the multispecies family arises — a family unit composed of both human and non-human animals, distinct in the particularities of their species but united by the affection intrinsic to a family. Consequently, family disputes have emerged in which multispecies families seek protection from the Judiciary to safeguard rights equivalent to those of legally recognized families, such as custody and the provision of support for their domestic animals. In this context, it is essential to analyze the current legal status of animals under Brazilian law, the concept of the multispecies family, as well as the ongoing conflicts involving such families. Furthermore, it is crucial to examine the current legal treatment of multispecies families within the legal system and what measures are being taken to resolve these disputes — and how the legal framework could evolve to address this purpose.
