PROPERTY VIOLENCE AGAINST WOMEN IN ROMANTIC RELATIONSHIPS: AN ANALYSIS IN LIGHT OF THE PROTECTION OF PERSONALITY RIGHTS

Abstract

This article analyzes property violence against women in affective relationships from the perspective of the protection of personality rights, investigating how this form of violence compromises dignity, autonomy, and the free development of women's personality. The main objective is to examine the legal framework of property violence within the Brazilian legal system and its relationship with personality rights. To achieve this, the study seeks to understand the legal foundations of domestic and family violence against women, identify manifestations of property violence in affective relationships and their normative provisions, as well as analyze personality rights as a means of protecting women's dignity. Furthermore, it evaluates existing protection mechanisms and the main challenges faced in combating this form of violence. The research adopts a deductive method with a qualitative approach, using bibliographic and documentary review, including legislation, scientific articles, and empirical data from official sources. Data interpretation is carried out from a hermeneutic perspective, guided by fundamental rights and the principle of human dignity. It is concluded that property violence constitutes a silent and structural form of violation of personality rights, requiring more effective and sensitive legal responses aligned with the realities experienced by women in affective relationships.
