THE JUDICIALIZATION OF HEALTHCARE IN BRAZIL AND ITS IMPACTS ON THE EFFECTIVENESS OF PUBLIC POLICIES

The judicialization of health in Brazil is characterized by the growing search for the Judiciary to guarantee access to medicines and procedures not provided by the Unified Health System. This study is justified by the need to understand the impacts of this phenomenon on the effectiveness of public policies, supporting debates on institutional reforms and sustainability of health systems. The main objective is to analyze the impacts of health judicialization on the effectiveness of public policies in Brazil, identifying tensions between guaranteeing individual rights and sustainability of collective actions. The methodology is based on exploratory bibliographic research, with qualitative analysis of scientific literature, judicial decisions, management reports, and documents from international organizations. The results show exponential growth of lawsuits concentrated on high-cost medicines, budgetary impacts that compromise planning, concentration of demands in groups with greater access to legal services, and heterogeneous results of dejudicialization strategies. It is concluded that judicialization represents a symptom of structural weaknesses in health systems, requiring reforms that transcend palliative solutions, combining strengthening of management capacities, expansion of transparency, and qualification of social participation to reconcile guarantee of rights with sustainability of policies.
