ROBERT ALEXY'S THOUGHTS ON DECISIONS AGAINST LEGEM

The purpose of this article is to study Robert Alexy's thinking in contra legam decisions, with philosophical thinking being the theoretical framework of the research. Every discussion turns to these decisions based on extreme injustice and injustice. The study of these decisions leads us to the conclusion that they are part of the concept of law defended by Alexy. The methodology used was analysis, using books as research sources. The analysis leads us to a result that is necessary to know: it is possible to assess judicial decisions that deviate from the rite used to apply the norm, that is, they contradict the text of the law, so that justice is achieved and the law is applied within the law based on the idea of the aforementioned philosopher.
