This article This article aims to comparatively analyze the legal protection of personal data in Brazil and the United States, in light of Law No. 13.709/2018 (General Data Protection Law – LGPD) and related U.S. legislation. The research employed a qualitative, descriptive, and comparative approach, based on bibliographical and documentary analysis. Through the examination of legal texts, doctrinal works, and institutional publications, the study sought to identify the main similarities and differences between both legal systems, particularly regarding the effectiveness of privacy and informational freedom rights. The results indicate that the Brazilian model presents a centralized legal framework, constitutionally grounded and supervised by the National Data Protection Authority, while the U.S. system remains fragmented and marked by contractual self-regulation. Nevertheless, both share a common concern for protecting human dignity, privacy, and individual autonomy. It is concluded that the consolidation of data protection requires not only solid legislation but also the strengthening of digital responsibility and international cooperation toward informational security.
