LIBERDADE DE EXPRESSÃO E DIGNIDADE DA PESSOA HUMANA: ANÁLISE ACERCA DO RACISMO NAS REDES SOCIAIS

In this article, we analyze the limits of freedom of expression in the 1988 Federal Constitution in relation to the protection of human dignity, focusing on cases of racist manifestations on social networks. The study aims to understand how Brazilian constitutional law and the Supreme Federal Court have treated racism as an unconstitutional act that violates fundamental rights. A qualitative methodology was adopted, based on bibliographic and documentary research, including constitutional doctrine, legislation, and recent court decisions. The research demonstrates that racist discourse cannot be considered a legitimate exercise of freedom of expression, as it directly violates the principles of equality and human dignity. It was also observed that digital platforms play an important role in content moderation, requiring the establishment of clear regulatory mechanisms. We conclude that combating online racism constitutes a legal and social duty to protect human dignity, reaffirming that freedom of expression cannot be used as a justification for discriminatory practices. This study contributes to the legal debate on the effectiveness of fundamental rights in the digital environment and proposes paths for a fair and coherent application of the law in addressing online racism.
