THE ROLE OF THE BRAZILIAN ELECTORAL COURT IN COMBATING DISINFORMATION ON SOCIAL MEDIA: CHALLENGES AND EFFECTIVENESS IN THE 2018 AND 2022 ELECTIONS

Social networks have become decisive arenas for political communication and the shaping of public opinion, profoundly transforming the Brazilian democratic process. The spread of disinformation and false content — so-called fake news — poses a serious threat to the legitimacy of elections and public trust in institutions. This study analyzes the role of the Brazilian Electoral Justice in addressing this phenomenon, focusing on the 2018 and 2022 elections, and highlights the challenge of reconciling freedom of expression with the protection of electoral integrity. The research, qualitative and exploratory in nature, is based on a bibliographic review and documentary analysis of legal norms, resolutions, and reports from the Superior Electoral Court (TSE). Initiatives such as the Program to Combat Disinformation and Resolutions No. 23.610/2019 and No. 23.732/2024 represented significant advances in adapting Electoral Law to the digital reality. However, challenges remain regarding the practical effectiveness of these measures, the dependency on technology platforms, and the need for greater media education. It is concluded that confronting disinformation requires an integrated strategy that combines regulation, technology, and citizenship to safeguard popular sovereignty and the authenticity of the vote in a context marked by post-truth and informational polarization.
