JOHN RAWLS' THEORY OF JUSTICE AND THE JUDICIALIZATION OF PUBLIC HEALTH POLICIES IN BRAZIL

This article analyzes the relationship between John Rawls' theory of justice and the judicialization of health policies in Brazil. It starts with a main question: is it possible to use Rawlsian principles as a parameter of justice for the judiciary's actions in the face of state omission in health demands in Brazil? Based on a deductive method and bibliographical research, the foundations of justice as equity, especially the principle of difference, and its potential for application in the Brazilian institutional context are analyzed. It is noted that judicialization can be interpreted as a mechanism for correcting inequalities, as long as it is guided by ethical and distributive criteria connected to the Rawlsian proposal. However, practical insufficiencies and selectivity in access to justice pose obstacles to the full implementation of this theory. Throughout the work, criticisms of Rawls' theory will be discussed, as well as the possibilities of its application in the health system and the role of the judiciary in the form of equitable justice.
