Abstract

The present study aims to analyze the economic efficiency of hybrid legal systems, characterized by the coexistence of Civil Law and Common Law elements in various global jurisdictions. The research seeks to understand how the interaction between the rigor of codified principles and the weight of jurisprudential precedents reconfigures legal certainty, transactional costs, and economic development itself. To this end, bibliographic research and comparative analysis were carried out, examining classical and recent doctrines on legal systems, as well as empirical studies on economic efficiency. The results indicate that hybrid systems can offer flexibility and adaptability, reconciling normative certainty and judicial pragmatism, although institutional and cultural challenges may limit their effectiveness.
