THE RULES OF JUSTIFICATION OF LEGAL DISCOURSE IN ROBERT ALEXY'S THEORY OF ARGUMENTATION

This essay addresses the rules of justification for legal discourse in Robert Alexy's Theory of Legal Argumentation. The main objective is to analyze the internal and external rules of justification proposed by Alexy, so that jurists can construct rational arguments capable of grounding their legal claims and decisions. The essay also demonstrates, based on Alexy's thesis of legal argumentation, the connection between law and morality, as well as the distinction between rules and principles. The theoretical motivation lies in providing legal practice with a rational foundation that transcends the mere subsumption of the norm to the specific case, in order to legitimize judicial decisions and allow them to be subject to claims of correction.
