HUMAN DIGNITY: MULTILEVEL PROTECTION OF THE FUNDAMENTAL RIGHT TO A NAME IN RELATION TO SEXUAL ORIENTATION AND GENDER IDENTITY

The essence of human dignity is inherent to all individuals and has been recognized by the Brazilian Supreme Federal Court as a super-principle. The change of name and gender emerges as a crucial aspect of the affirmation of authenticity for the LGBTQ+ community, given the legal, social, and psychological challenges faced by LGBTQ+ individuals in seeking such recognition. Therefore, the topic holds significant social and legal relevance, and this article aims to contribute to the construction of more inclusive societies that respect human diversity. The general objective of the article is to analyze and discuss the multilevel protection of the fundamental right to a name in relation to sexual orientation and gender identity, within the broader context of human dignity. The methodology adopted is interdisciplinary, combining qualitative and quantitative methods, comparative analysis, and case studies. The research conducts a bibliographic review and examines international and national normative frameworks. It is concluded that there is a need for progressive interpretations, legislative adaptations, and a culture that values individual identities, thereby reaffirming the commitment to the promotion of human dignity and the effective protection of fundamental rights related to gender identity and sexual orientation.
