The sovereign, as the embodiment of the general will, reveals a dual structural demand. On the one hand, it requires the figure of the legislator, whose task is to formulate and propose laws capable of rendering the collective ends intelligible, insofar as the political body, in its entirety, does not always possess the clarity necessary to discern immediately the substance of the common good. On the other hand, there arises the indispensable need for government, the authority charged with the normative execution and, consequently, with the very institution of the governmental order. The core of the problem, therefore, lies in the foundational act through which government is established—an act that Rousseau deems decisive, inasmuch as it must conform to the principles of popular sovereignty and the general will, lest it degenerate into spurious forms of domination. Thus, the guiding question of the present inquiry may be articulated as follows: in what manner can the constitution of a politically legitimate society be conceived in light of Rousseau’s democratic theory?
