EL IMPACTO DE LA TECNOLOGÍA Y LA FALTA DE REGULACIÓN EN LOS DELITOS SEXUALES VIRTUALES CONTRA NIÑOS Y ADOLESCENTES

Resumen

En este artículo analizo el impacto de la tecnología y la falta de regulación en el aumento de los delitos sexuales virtuales contra niños, niñas y adolescentes. Busco comprender de qué manera la rápida evolución tecnológica, sumada a la ausencia de políticas públicas eficaces, ha contribuido al crecimiento de las prácticas de abuso y explotación en el entorno digital. Utilizo una metodología de carácter cualitativo y bibliográfico, basada en estudios recientes sobre derecho, tecnología y protección infantil y juvenil. Examino las lagunas de la legislación vigente, la fragilidad de las políticas preventivas y la carencia de mecanismos de cooperación internacional orientados a enfrentar los delitos virtuales. Los resultados indican que la legislación actual es reactiva y fragmentada, sin acompañar la velocidad de las innovaciones tecnológicas, lo que amplía la vulnerabilidad de las víctimas. Concluyo que la protección de la infancia en el ciberespacio exige un enfoque interdisciplinario que integre regulación jurídica, ética digital y educación preventiva. Defiendo la necesidad de políticas públicas integradas y de la creación de una gobernanza digital global que asegure el equilibrio entre el avance tecnológico y la protección de los derechos fundamentales de niños, niñas y adolescentes.
