FROM FORMALISM TO ALGORITHMIC EFFICIENCY: STRATEGIC LITIGATION MANAGEMENT AND POST-BUREAUCRATIC MODERNIZATION IN PUBLIC LAWSUIT MANAGEMENT AT THE FEDERAL ATTORNEY GENERAL’S OFFICE

Abstract

This study addresses the transition of Public Administration toward a more dynamic and fast-paced environment, driven by globalization and advancements in information technology. The purpose of this article is to demonstrate the development of the Strategic Litigation Management model established by Normative Ordinance PGF/AGU No. 64 of July 30, 2024, and how screening automation and the use of metadata mitigate procedural rigidity, thereby contributing to the principle of efficiency within the Federal Attorney General’s Office (PGF). The theoretical framework is anchored in Max Weber’s legal-rational concept of bureaucracy, contrasting its advantages (such as the uniformity of routines) with its dysfunctions, including the excessive formalism and over-conformity identified by Robert Merton. Methodologically, a monographic procedure was adopted alongside bibliographic and documentary research techniques, focusing on the analysis of the aforementioned ordinance. It concludes that the automation of purely mechanical stages acts as an antidote to bureaucratic pathology, freeing the intellectual workforce of Federal Attorneys for high-complexity cases and serving as a replicable benchmark for other state and municipal attorney offices.
