THE UNCONVENTIONAL POLICE RESPONSE AND THE EXCLUSION OF ILLEGALITY: A TECHNICAL AND LEGAL ANALYSIS OF SELF-DEFENSE IN ARMED CONFRONTATION

The use of firearms in policing is analyzed through a lay lens, diverging from the reality of armed confrontations. This study investigates whether the "unconventional response" doctrine characterizes the justification of self-defense. A qualitative interdisciplinary approach is adopted, integrating criminal law, police sciences, and forensic medicine. Results demonstrate that lethal stress triggers physiological changes, such as tunnel vision and amnesia, rendering precision techniques unfeasible. Statistically, the 19.3% hit rate and the ballistic "window of vulnerability" justify the volume of fire based on the persistence of risk. The Bertioga Case analysis highlights legal uncertainty in judgments lacking forensic expertise, which criminalize survival reactions. It concludes that unconventional response is a technical necessity, urging the adoption of judicial decisions grounded in police sciences to mitigate officer hesitation and victimization.
