FREEDOM OF EXPRESSION ON THE INTERNET AND ITS LEGAL LIMITS

The general objective of this article is to analyze freedom of expression on the internet and its legal limits in the Brazilian context. The specific objectives were to understand the concept of freedom of expression and its historical evolution, especially in the digital environment; to investigate the main conflicts arising from the misuse of freedom of expression online, such as hate speech, fake news, and offenses; and to highlight the role of the Brazilian Internet Civil Framework (Marco Civil da Internet) and other legislation in regulating freedom of expression online. This study is justified by the growing importance of the internet as the main means of communication and expression, requiring an understanding of the legal limits of freedom of expression in the digital environment. Regarding methodology, this study adopts a qualitative approach with exploratory and descriptive nature, aiming to understand the legal limits of freedom of expression on the internet through a theoretical-documentary analysis. The research is based on a bibliographic and legislative review, utilizing legal doctrines, scientific articles, current legislation, and official documents addressing the topic. It was found that despite legislative advances, challenges remain in the practical application of these norms, especially given the rapid technological changes. Therefore, future research is suggested to investigate the effectiveness of laws in concrete cases, digital education for users, and the impact of emerging technologies such as algorithms and artificial intelligence in content moderation, contributing to the improvement of public policies that ensure a fair, safe, and democratic digital environment.
