THE LEGAL RECOGNITION OF ANIMALS AS SUBJECTS OF RIGHTS: REFLECTIONS ON SHARED CUSTODY IN CASES OF SEPARATION

This study aims to analyze the effects of the legal recognition of animals as sentient beings in cases of shared custody following marital separation, considering the existing gaps in Brazilian law. The social and emotional evolution regarding the relationship between humans and companion animals highlights the need to review civil norms that still classify them as movable property, according to Article 82 of the Civil Code. The research is based on the hypothesis that the absence of specific legislation addressing animal sentience creates legal uncertainty in custody decisions involving pets, especially in separation cases, where emotional bonds and animal welfare are often overlooked. Thus, the study seeks to understand how Brazilian Civil Law has interpreted the legal personality of animals by investigating doctrinal theories and jurisprudence that indicate a gradual humanization of the legal protection of non-human beings. Furthermore, it explores the compatibility between the concept of sentience and the recognition of animals as rights-bearing subjects, drawing on authors such as Tartuce (2022), Chinellato (2010), Nader (2016), and Amado (2015), as well as court decisions from Rio de Janeiro and São Paulo that acknowledge the existence of multispecies families. The methodology adopted is qualitative and bibliographic, based on the analysis of doctrinal works, scientific articles, and related legislation. The study concludes that jurisprudential advances and the growing recognition of emotional bonds between guardians and animals demonstrate the urgent need for specific regulation of pet custody, ensuring legal and emotional protection for animals based on the principles of dignity and well-being.
