COMPENSATION FOR MORAL DAMAGES IN LABOR COURT: AN ANALYSIS OF THE DECISION-MAKING PATTERNS OF THE REGIONAL LABOR COURT OF THE 21ST REGION

This paper aims to analyze moral damages in the sphere of Labor Law. To achieve this objective, a data survey was carried out regarding the decisions of the Regional Labor Court of the 21st region in the period from May to December 2024, as well as bibliographical research on the subject. Thus, the jurimetric research was based on the Decision Analysis Methodology (MAD) and in the method proposed by Bardin to collect the necessary data. Regarding the methodology, this research is classified as qualitative, with bibliographical technical procedures, and quantitative, regarding the approach, as it works with statistical panel data. The results obtained demonstrate that the TRT-21 acts with evidentiary rigor in granting compensation for moral damages, requiring proof of unlawful conduct, damage and causal link, and applying values proportional to the severity of the damage.
