PENAL REGIME PROGRESSION: ANTINOMIES, GAPS AND DIFFICULTIES OF PRACTICAL APPLICATION

The progressive system was adopted by the 1984 reform of the General Part of the Penal Code and the Penal Enforcement Law, based on the theory of positive special prevention, that is, aiming at the individual's resocialization. The objective of this paper is to discuss the progressive system for serving prison sentences, focusing on the requirements for granting the penal benefit, highlighting the understanding summarized by the Superior Courts on the subject. With an exploratory approach, the research uses a bibliographic and documentary review. It is observed that legislative reforms in the rules regarding regime progression have brought profound changes to the progressive system. Furthermore, this succession of subsequent laws is marked by antinomies and gaps, hindering the practical application of this important benefit of penal enforcement.
