Abstract

The increasing incidence of work-related mental disorders has intensified the legal debate regarding the employer’s responsibility in the prevention and management of psychosocial risks in the workplace. The update of Regulatory Standard No. 01 (NR-01), introduced by SEPRT Ordinance No. 6,730/2020, by establishing the Occupational Risk Management (GRO) and the Risk Management Program (PGR), expanded the preventive approach in the field of occupational health and safety, requiring organizations to identify, assess, and control not only physical, chemical, and biological risks, but also psychosocial risks.This article analyzes the constitutional foundations of worker health protection, examines the legal treatment given by NR-01 to occupational risks, and investigates the civil liability of employers in cases of omission in the management of psychosocial risks. The methodology adopted is deductive, based on bibliographic and case law research. It is concluded that the employer’s omission in effectively implementing psychosocial risk management may give rise to civil liability, grounded in the Federal Constitution, the Consolidation of Labor Laws, and the theory of enterprise risk.
