Abstract

This study aims to analyze the fundamental distinctions between precautionary and preliminary injunctions in the context of Environmental Law, based on the contributions of renowned jurist Ovídio Araújo Baptista. The research covers a detailed exploration of the institutes of provisional injunctions, highlighting their urgent modalities, such as precautionary and preliminary, in addition to evidentiary injunctions. The aim is to provide an in-depth understanding of these concepts. Additionally, the study is enriched with the analysis of two practical cases related to urgent injunctions, covering both precautionary and preliminary injunctions, for a more contextualized and practical application of the discussions presented.
