A pregnant incarcerated woman navigates between the roles of "mother" and "criminal," the former referring to something natural, an exclusive role of women; the latter denoting something that transgresses what is established by law, a deviation from what is morally accepted and imposed. When pregnancy intersects with crime and, consequently, with incarceration, the woman's vulnerability becomes clear, making it necessary to have a more careful and cautious approach towards this mother, paying attention to her needs and specificities. Considering the increasing number of women in the Brazilian prison system, including pregnant women and new mothers (INFOPEN, 2018), it is extremely important that issues related to the health of pregnant women and their babies begin to be included, in a meticulous and concise manner, in public policies not only at the state level but also nationally. This article aims to discuss the custody situation and the challenges continuously faced by pregnant women in the Ananindeua Women's Custody and Reintegration Unit, which occur mainly due to the lack of assistance from public policies for these women and even for the unborn child. This is an empirical study, conducted in a prison unit, where it was possible to understand whether or not pregnant women are being protected in prison, revealing a possible lack of state assistance and violation of human rights towards female inmates.
