QUILOMBOLA TERRITORIAL RIGHTS IN THE JURISPRUDENCE OF THE BRAZILIAN SUPREME COURT: A SYSTEMATIC REVIEW (2017-2025)

This systematic review examines the jurisprudence of the Brazilian Supreme Court (STF) regarding the territorial rights of quilombola communities from 2017 to 2024, following the PRISMA 2020 methodology. The objective was to systematically identify and analyze decisions that impact quilombola rights, either directly or indirectly, mapping trends, central arguments, and legal implications. Twelve decisions were analyzed after selection through rigorous eligibility criteria, including direct actions of unconstitutionality, extraordinary appeals, and claims of fundamental precept violations. The results demonstrate a predominantly favorable jurisprudence toward quilombola rights. Consolidation of the imprescriptibility of territorial rights, rejection of temporal frameworks, and strengthening of judicial protection against administrative delays were observed. The analysis reveals that the STF has adopted an expansive interpretation of quilombola constitutional rights, connecting these rights to principles of human dignity, cultural diversity, and social justice. The analyzed decisions establish important precedents for the protection of traditional communities and highlight the centrality of territory for the physical and cultural reproduction of these groups.
