Abstract

In Brazil, powers are divided into Executive, Legislative and Judiciary. The Judiciary says who has the right, who is right, in the real conflict of interests. The Executive is represented by mayors, governors and president of the republic, the Legislative by councilors, state, federal and district deputies and senators. The Judiciary, represented by the Judges of Law, the Military Court, the Labor Court, the State Court, the Electoral Court, Special Courts, Courts of Justice, the Superior Court of Justice and the Federal Supreme Court.  This great power allocated to the Judiciary causes an imbalance in the system of checks and balances, sometimes leading to decisions and actions contrary to the constitutional order itself, or against national interests.
