ANALYSIS OF THE FACTORS THAT INFLUENCE THE WITHDRAWAL OF PROTECTIVE MEASURES BY VICTIMS OF DOMESTIC VIOLENCE

Given the high rate of domestic violence in Brazil, emergency protective measures are seen as tools used to establish minimum standards of institutional protection for emotional relationships. Given the context of oppression that culminates in women's requests for the removal of protective measures, the study seeks to understand the true motivations. Therefore, the study aims to address the factors that influence the withdrawal of protective measures by victims of domestic violence. The methodology used was descriptive and qualitative research, based on a literature review and documentary analysis of laws, empirical studies, doctrine, case law, and official data. The results demonstrated that these protective measures are tools that judges use to protect women in situations of domestic, family, or intimate partner violence. The main reasons women demand the removal of protective measures are oppressive factors such as emotional, economic, social, and financial dependence, family and cultural pressure, and fear and institutional insecurity, which, in a way, highlights a significant failure of the State to provide security for women victims of violence.
